This End-User License Agreement (“Agreement”) is a legal agreement between you and Wheelie Clean Wash for use of the Wheelie Clean Wash website, related subdomains, and the Wheelie Clean Wash mobile application (together, the “Services”). By accessing or using the Services, you agree to this Agreement.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose: learning about our car wash, finding our location, and, when available, paying for washes, using loyalty rewards, sending eGifts, and viewing offers.
The Services, including text, logos, graphics, software, and trademarks, are owned by Wheelie Clean Wash or our licensors. This Agreement does not transfer ownership of any intellectual property to you.
If you create an account or use the app, you are responsible for keeping your login information confidential and for activity under your account. You agree not to misuse the Services, attempt to interfere with their operation, copy or reverse engineer the app, or use the Services for any unlawful purpose.
Wash purchases, club plans, loyalty points, prizes, and promotional offers are subject to availability and the terms shown at the time of purchase or redemption. Points, offers, and game prizes have no cash value unless we say otherwise in writing. We may change, suspend, or end promotions, loyalty benefits, or app features.
Use of our automatic wash, self-serve bays, vacuums, and other on-site equipment is at your own risk and subject to posted instructions. Follow height, vehicle, and safety restrictions. We are not responsible for pre-existing vehicle condition, aftermarket accessories, or damage caused by failure to follow posted rules.
The Services are provided “as is.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the website or app will be uninterrupted, error-free, or available at all times.
To the fullest extent permitted by law, Wheelie Clean Wash and its owners, employees, and vendors are not liable for indirect, incidental, special, or consequential damages, or for lost profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific wash or digital feature at issue during the 12 months before the claim, or $50 if you paid nothing.
We may suspend or terminate access to the Services if you violate this Agreement or if we discontinue a feature. You may stop using the Services at any time.
This Agreement is governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Venue for disputes shall be in courts located in Boundary County, Idaho, unless applicable law requires otherwise.
